Privacy Policy

Note: This document has been drafted to cover the requirements of PIPEDA, CASL, Meta Platform Terms, Stripe, and Google Maps API usage. It should be reviewed by a qualified Canadian privacy lawyer before being published as the official policy for Hausprice.

1. Introduction

Hausprice ("we," "us," or "our") operates an AI-powered market intelligence and marketing platform for Canadian real estate agents at hausprice.ca.

This Privacy Policy explains how we collect, use, disclose, and protect personal information when you use our website, platform, and related services (collectively, the "Service"). It applies to all users, including:

  • Real estate agents ("Realtors") who subscribe to Hausprice
  • Homeowners and buyers ("Portal Users") who interact with the Hausprice Portal or AI chatbot
  • Website visitors who browse our public pages

We are committed to protecting your privacy in accordance with Canada's Personal Information Protection and Electronic Documents Act (PIPEDA) and Canada's Anti-Spam Legislation (CASL).

By using Hausprice, you consent to the collection and use of information as described in this policy. If you do not agree, please do not use the Service.

2. Information We Collect

2.1 Information Realtors Provide Directly

When you create a Realtor account and use Hausprice, we collect:

  • Account information: Name, email address, phone number, brokerage name, and headshot photo.
  • Property data: Addresses, property details, comparable sales you enter, and property photos you upload.
  • Report data: AI-generated market reports, pricing analysis, condition assessments, and improvement recommendations.
  • Social media connections: If you connect your Instagram or Facebook account via Meta OAuth, we receive an access token that allows us to post content on your behalf. We do not store your Instagram or Facebook password.
  • Usage data: Which features you use, number of reports generated, and actions taken within the platform.

2.2 Information Collected from Portal Users (Homeowners and Buyers)

When homeowners or buyers interact with the Hausprice Portal, we collect:

  • Contact information: Name, email address, and phone number, captured conversationally through our AI chatbot.
  • Property interests: Which listings you viewed and questions you asked.
  • Conversation transcripts: Full transcripts of your conversations with our AI chatbot (see Section 5 for important information about our AI chatbot).
  • Commute queries: If you use the commute analysis feature, the workplace address you enter.
  • Location data: Only the property addresses you search for. We do not collect GPS coordinates, device location, or any background location data.

2.3 Information Collected from Website Visitors

  • Analytics data: Page views, referrer URL, and general browsing behaviour (aggregated, non-identifying).
  • Cookies: We use cookies only for authentication sessions. See Section 9 for details.

2.4 Information Collected Through Payment Processing

When you subscribe to a paid plan, payment is processed by Stripe. We receive confirmation of your subscription status, billing history, and plan details. We never receive, store, or have access to your full credit card number, debit card number, or banking details. These are handled entirely by Stripe in accordance with PCI-DSS standards.

2.5 Information Collected Automatically

  • Device information: Browser type, operating system, and device type.
  • Log data: IP address, access times, and referring URLs.

3. How We Use Your Information

We use the information we collect for the following purposes:

We do not sell your personal information to any third party. Ever.

We do not send marketing or promotional emails without your explicit opt-in consent, in compliance with CASL. Transactional emails (receipts, account notifications, service updates) are exempt from CASL consent requirements as they relate directly to your use of the Service.

4. The Realtor-Portal User Relationship

Hausprice serves as a tool for Realtors. When a homeowner or buyer interacts with a Realtor's Hausprice Portal:

  • The Realtor receives your information. Contact details, property interests, and conversation transcripts are shared with the Realtor whose Portal you are using. This is a core function of the Service — the Portal exists to connect you with the Realtor.
  • The Realtor is responsible for their own use of your data. Once a Realtor receives your contact information, their subsequent use of that information (such as follow-up calls or emails) is governed by their own privacy practices and applicable laws, including CASL and PIPEDA.
  • We retain Portal User data. We store conversation transcripts and contact information to provide the Service. You may request deletion at any time (see Section 8).
  • You can identify which Realtor receives your data. The Realtor's name and brokerage are displayed on their Portal before you provide any personal information.

5. AI-Powered Features — Important Disclosures

Hausprice uses artificial intelligence extensively. We believe in full transparency about how AI is used in our Service.

5.1 AI Chatbot Disclosure

The Hausprice Portal chatbot is powered by artificial intelligence, not a human. When you interact with the chatbot:

  • You are conversing with an AI system, not the Realtor or a Hausprice employee.
  • The chatbot uses AI to answer questions about properties, neighbourhoods, and market conditions.
  • Conversation transcripts are stored and shared with the Realtor whose Portal you are using.
  • The AI may make errors. Information provided by the chatbot is for general informational purposes only and should not be relied upon as professional advice.

5.2 AI-Generated Reports and Content

Hausprice uses AI to:

  • Analyze property photos to assess condition, materials, finishes, and renovation quality.
  • Generate market reports that support a Realtor's pricing recommendation with data.
  • Create social media content (posts, captions, images) for Realtors to publish on their connected accounts.
  • Generate listing descriptions and marketing copy.

All AI-generated content is clearly identified as AI-generated. AI-generated reports are market analysis tools, not certified appraisals, and should not be relied upon for legal, financial, or transactional decisions.

5.3 AI Service Providers

AI processing is performed by third-party AI providers (see Section 7). When your data is sent to these providers:

  • Only the minimum data necessary for the specific task is transmitted.
  • Our AI providers are contractually prohibited from using your data to train their own models (where such contractual terms are available).
  • Photo analysis, report generation, and chatbot responses involve sending relevant data to AI providers for processing.

6. AI Training and Service Improvement

6.1 How We Improve Our Service

With your consent, property photos and associated analysis data (condition assessments, detected materials, room classifications) may be used to improve the accuracy and quality of our AI analysis capabilities.

6.2 Anonymization

Before any data is used for service improvement or AI model training:

  • All personally identifiable information is removed (names, email addresses, phone numbers, exact addresses).
  • Data is aggregated so that individual properties cannot be identified.
  • Only anonymized, structured metadata (room type, condition score, material type, general location area) is retained.

6.3 Your Right to Opt Out

You may opt out of AI training use at any time by contacting us at info@hausprice.ca or through your account settings. Opting out will not affect your access to any features of the Service.

7. Third-Party Service Providers

We share personal information with the following categories of third-party service providers, solely for the purposes of operating the Service:

Google Maps Platform Data Use

In accordance with Google Maps Platform Terms of Service:

  • We use Google Maps data solely to provide features within the Hausprice Service.
  • We do not cache Google Maps data beyond what is permitted by the Google Maps Platform Terms.
  • Google Maps data is not used to create competing products or services.
  • Our use of Google Maps is also governed by Google's Privacy Policy.

Meta Platform Data Use

In accordance with Meta Platform Terms:

  • We only access Instagram and Facebook data that you explicitly authorize through the Meta OAuth consent flow.
  • We use your Meta access token solely to post content on your behalf when you initiate a post through Hausprice.
  • We do not sell, license, or share Meta user data with any third party.
  • You may revoke Hausprice's access to your Meta accounts at any time through your Meta account settings or your Hausprice account settings.
  • We delete Meta access tokens within 30 days of account termination or access revocation.
  • We comply with all applicable Meta Platform Policies, including the Meta Platform Terms and Developer Policies.

All Third-Party Providers

All third-party service providers are:

  • Contractually bound to protect your data and use it only for the purposes we specify.
  • Required to maintain appropriate security measures.
  • Prohibited from selling or using your data for their own marketing purposes.

8. Data Location

Some of our service providers are based in the United States. As a result, your personal information may be processed and stored on servers located in the United States and Canada.

Specifically:

  • Vercel (hosting): Servers primarily located in the United States.
  • Supabase (database): Cloud infrastructure that may involve US-based servers.
  • Stripe, Anthropic, Google, Meta, Resend: US-based companies.

Where personal information is transferred outside of Canada, we ensure that appropriate contractual safeguards are in place to protect your information in accordance with PIPEDA. You acknowledge and consent to this transfer by using the Service.

9. Cookies and Tracking

Hausprice uses a minimal number of cookies:

  • Authentication cookies: Required for the Service to function. These maintain your login session and cannot be disabled while using the Service.

We do not use:

  • Advertising cookies or tracking pixels
  • Cross-site tracking technologies
  • Third-party marketing cookies
  • Fingerprinting or device identification beyond standard log data

We do not sell cookie data or share it with advertisers.

10. Data Retention

We retain your personal information only as long as necessary to fulfill the purposes described in this policy:

11. Your Rights Under PIPEDA

Under Canada's Personal Information Protection and Electronic Documents Act (PIPEDA), you have the following rights:

  • Right to access: You may request a copy of the personal information we hold about you.
  • Right to correction: You may request that we correct any inaccurate or incomplete personal information.
  • Right to deletion: You may request that we delete your personal information, subject to legal retention requirements.
  • Right to withdraw consent: You may withdraw your consent for specific data uses (such as AI training or social media posting) at any time. Withdrawal of consent for core Service functions may require account closure.
  • Right to data portability: Realtors may export their property data, reports, and lead information at any time through the platform or by request.
  • Right to file a complaint: If you are not satisfied with our response, you may file a complaint with the Office of the Privacy Commissioner of Canada.

How to Make a Request

Send your request to info@hausprice.ca with the subject line "Privacy Request." Please include your full name and the email address associated with your account.

Response Timeline

We will acknowledge your request within 5 business days and provide a substantive response within 30 calendar days. If we need additional time, we will notify you of the reason for the extension.

12. Data Security

We implement appropriate technical and organizational measures to protect your personal information, including:

  • Encryption in transit: All data transmitted between your device and our servers is encrypted using TLS (Transport Layer Security).
  • Encryption at rest: Sensitive data stored in our databases is encrypted at rest.
  • Access controls: Access to personal information is restricted to authorized personnel on a need-to-know basis.
  • Authentication security: Passwords are hashed and never stored in plain text. We support Google OAuth for secure authentication.
  • Third-party security: We select service providers that maintain appropriate security certifications and practices.
  • Regular reviews: We periodically review and update our security practices.

While we strive to protect your information, no method of transmission or storage is 100% secure. If you become aware of a security incident, please contact us immediately at info@hausprice.ca.

13. CASL Compliance (Canada's Anti-Spam Legislation)

We comply with Canada's Anti-Spam Legislation (CASL) in all electronic communications:

  • Transactional emails (account confirmations, password resets, receipts, service notifications) are sent without additional consent, as they relate directly to your use of the Service and are exempt under CASL.
  • Commercial electronic messages (marketing emails, promotional content, newsletters) are only sent with your express opt-in consent. You may unsubscribe at any time using the unsubscribe link in any email.
  • All commercial emails identify Hausprice as the sender, include our contact information, and contain a working unsubscribe mechanism.

For Realtors using Hausprice to communicate with leads: You are responsible for ensuring your own compliance with CASL when contacting Portal Users whose information was captured through Hausprice. We recommend obtaining express consent before sending commercial messages.

14. Children's Privacy

Hausprice is not directed at individuals under the age of 16. We do not knowingly collect personal information from children under 16. If we become aware that we have collected personal information from a child under 16, we will take steps to delete that information promptly.

If you are a parent or guardian and believe your child has provided us with personal information, please contact us at info@hausprice.ca.

15. Changes to This Policy

We may update this Privacy Policy from time to time. When we make material changes:

  • We will provide at least 30 days' notice before the changes take effect.
  • We will notify you by email (if you have an account) and by posting a prominent notice on our website.
  • We will update the "Last Updated" date at the top of this policy.

Your continued use of the Service after the effective date of a revised policy constitutes your acceptance of the changes.
