Terms of Service

Note: This document has been drafted to cover the requirements of Canadian SaaS compliance, Meta Platform Terms, Stripe, and general business operations. It should be reviewed by a qualified Canadian lawyer before being published as the official Terms of Service for Hausprice.

1. Acceptance of Terms

By accessing or using Hausprice (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

These Terms constitute a legally binding agreement between you and Hausprice ("we," "us," or "our"), operating in Ontario, Canada. We may update these Terms from time to time. We will notify you of material changes at least 30 days before they take effect. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

2. Description of Service

Hausprice is an AI-powered market intelligence and marketing platform for Canadian real estate agents. The Service provides tools to help Realtors create professional, data-backed market analysis reports to support their pricing recommendations.

The Service includes:

  • AI-powered property photo analysis (condition, materials, finishes, renovation quality)
  • Market analysis report generation that supports a Realtor's pricing recommendation
  • Comparable sales analysis tools
  • Improvement recommendations with general impact assessments
  • Social media content generation and auto-posting (via connected Meta accounts)
  • AI chatbot (the "Hausprice Portal") for buyer and homeowner engagement
  • Listing description generator
  • Neighbourhood and commute analysis tools

2.1 What Hausprice Is NOT

Critical — Please Read Carefully

  • Hausprice is a market analysis tool, NOT an appraisal service.
  • Reports generated by Hausprice are NOT certified appraisals. They are not prepared by licensed appraisers and do not comply with the Canadian Uniform Standards of Professional Appraisal Practice (CUSPAP) or any other appraisal standard.
  • Hausprice does NOT provide financial advice, investment advice, legal advice, tax advice, or any other form of professional advice.
  • Hausprice does NOT guarantee property values, sale prices, days on market, renovation ROI, or any other market outcome.
  • AI-generated content (reports, chatbot responses, social media posts, listing descriptions) is produced by artificial intelligence and may contain errors or inaccuracies.

3. Account Registration

To use the Service, you must create an account. When registering, you agree to:

  • Provide accurate, current, and complete information.
  • Keep your login credentials secure and confidential.
  • Notify us immediately of any unauthorized access to your account.
  • Accept responsibility for all activity that occurs under your account.
  • Not share your account credentials with others or allow others to access your account.

We reserve the right to suspend or terminate accounts that contain inaccurate information or are used in violation of these Terms.

4. Subscriptions and Payments

4.1 Pricing

Hausprice is available as a monthly subscription:

  • Pro Plan: $99 CAD per month — unlimited reports, full access to all features, one (1) seat.
  • Founding Member Plan: $79 CAD per month (locked for life) — available to the first 50 beta Realtors by invitation only. Same features as Pro.

All prices are in Canadian Dollars (CAD) and are subject to applicable taxes.

4.2 Billing

  • All payments are processed by Stripe, a PCI-DSS compliant third-party payment processor.
  • By subscribing, you authorize us to charge your selected payment method on a recurring monthly basis.
  • You are responsible for keeping your payment information current.
  • If a payment fails, we will notify you and may suspend access to paid features until payment is resolved.

4.3 Cancellation

You may cancel your subscription at any time through your account settings or by contacting us at info@hausprice.ca.

  • Your access continues until the end of your current billing period. No refunds are issued for partial months.
  • After cancellation, you retain access to your data and may export it before your account reverts to limited access.
  • Founding Member pricing is locked for life — if you cancel and resubscribe later, the founding rate may no longer be available.

4.4 Price Changes

We may change subscription prices with at least 30 days' notice. Price changes take effect at the start of your next billing cycle. Founding Member pricing is exempt from price increases.

4.5 Free Portal Users

Homeowners and buyers who interact with the Hausprice Portal (AI chatbot) do so free of charge. Portal Users are subject to these Terms.

5. AI-Generated Content Disclaimer

Critical — Please Read Carefully

Hausprice uses artificial intelligence to generate market analysis reports, chatbot responses, social media content, listing descriptions, and other content. By using the Service, you understand and agree to the following:

5.1 Reports Are Market Analysis Tools, NOT Appraisals

The market analysis reports generated by Hausprice are AI-generated market analysis tools designed to support a Realtor's professional opinion. They are:

  • NOT certified appraisals.
  • NOT prepared, reviewed, or endorsed by licensed appraisers.
  • NOT compliant with CUSPAP, USPAP, or any appraisal standard.
  • NOT a substitute for a professional appraisal, broker price opinion, or comparative market analysis prepared by a licensed professional.

5.2 Estimates Are Ranges, Not Guarantees

All property value estimates are presented as ranges, not exact figures. Actual property values may differ significantly from estimated ranges. Market conditions, property-specific factors, buyer behaviour, and many other variables that AI cannot fully account for will affect actual outcomes.

5.3 Not Professional Advice

Hausprice outputs do NOT constitute financial advice, investment advice, legal advice, tax advice, mortgage advice, or any other form of professional advice. The Service provides supplementary market information only.

5.4 Do Not Rely Solely on Hausprice

You should NOT rely solely on Hausprice reports or outputs for:

  • Setting a listing price (reports support your recommendation, they do not replace your professional judgment)
  • Buying or selling a property
  • Making mortgage or lending decisions
  • Insurance coverage decisions
  • Tax assessments or appeals
  • Legal proceedings or disputes
  • Any financial, legal, or transactional decision

Always consult qualified, licensed professionals — including certified appraisers, real estate lawyers, financial advisors, and mortgage professionals.

5.5 AI Limitations

AI-generated content may be inaccurate due to:

  • Poor photo quality or misleading images
  • Incomplete or outdated property data
  • Unusual property features not well-represented in the AI's training
  • Rapidly changing market conditions
  • Regional variations in property markets
  • General limitations of artificial intelligence technology

5.6 AI Chatbot Disclosure

The Hausprice Portal chatbot is an AI system, not a human being. Portal Users are interacting with artificial intelligence, not with the Realtor or a Hausprice employee. The chatbot may provide incorrect information. All chatbot responses are for general informational purposes only.

5.7 Social Media Content

AI-generated social media content (posts, captions, images) is created by AI and published to your connected accounts only when you choose to post. You are responsible for reviewing all AI-generated content before publishing. Hausprice is not liable for the accuracy or impact of social media content you choose to publish.

5.8 Assumption of Risk

By using Hausprice outputs in any capacity, you assume full responsibility for how you use that information. Hausprice expressly disclaims all liability for any decisions, actions, or outcomes based on AI-generated content.

6. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree NOT to:

  • Present Hausprice reports as certified appraisals or misrepresent their nature to clients, lenders, insurers, or any third party.
  • Upload fabricated or misleading property data or photos to generate inaccurate reports.
  • Generate reports for fraudulent purposes, including but not limited to mortgage fraud, insurance fraud, or tax fraud.
  • Scrape, crawl, or use automated tools to access the Service or extract data, except through APIs we explicitly provide.
  • Reverse engineer the Service, its AI models, or underlying algorithms.
  • Resell, redistribute, or sublicense reports, data, or content obtained from the Service without our written consent.
  • Circumvent security measures, access controls, or usage limits.
  • Upload content that is illegal, harmful, defamatory, or violates the rights of others.
  • Impersonate another person or entity, or misrepresent your professional status or affiliation.
  • Use the Service to harass, abuse, or harm others.
  • Spam or mass-distribute content generated by the Service in violation of CASL or any applicable anti-spam law.
  • Misuse Meta integrations by posting content that violates Meta's Community Standards or Terms of Service through the Hausprice social posting feature.

Violation of these restrictions may result in immediate suspension or termination of your account without refund.

7. Data Ownership and Intellectual Property

7.1 Your Data — You Own It

You retain full ownership of all data you provide to Hausprice, including:

  • Property data, addresses, and details you enter
  • Photos you upload
  • Comparable sales you select
  • Your recommended pricing
  • Your professional profile information

7.2 Your Reports

Reports generated by Hausprice belong to you (the Realtor who generated them). You may share, distribute, and use your reports in your business without restriction, subject to the following:

  • You must not present reports as certified appraisals.
  • You must not remove or obscure disclaimers contained in the reports.
  • The report format, design, layout, and AI-generated analysis text are created using Hausprice's technology. You receive a perpetual, non-exclusive license to use your generated reports for your business purposes.

7.3 Data Export and Deletion

You may export your data at any time through the platform or by contacting us at info@hausprice.ca. Upon account closure, you may request a full export of your data. We will provide your data in a standard, machine-readable format within 30 days of your request.

You may request deletion of your data at any time, subject to legal retention requirements (see our Privacy Policy).

7.4 Portal User Data (Leads)

Contact information and conversation data captured through your Hausprice Portal belongs to both you and the Portal User:

  • You (the Realtor) receive this information to follow up with potential clients. You are responsible for complying with PIPEDA and CASL in your use of this data.
  • The Portal User retains rights over their personal information and may request deletion at any time.
  • Hausprice stores this data to provide the Service and may use anonymized, aggregated data for service improvement.

7.5 Our Intellectual Property

Hausprice, including but not limited to the platform, website, software, AI models, algorithms, report templates, design, logos, and trademarks, is owned by Hausprice and protected by Canadian and international intellectual property laws. You may not copy, modify, distribute, or create derivative works from our intellectual property without our written consent.

7.6 Photo Usage License

By uploading photos to the Service, you grant Hausprice a non-exclusive, worldwide, royalty-free license to:

  • Analyze: Process your photos using AI to generate reports and assessments.
  • Store: Retain your photos on our servers for the purpose of providing the Service.
  • Improve (with consent): Use anonymized versions of your photos and analysis results to improve our AI models. You may opt out at any time without affecting your access to the Service.

Your photos are never publicly displayed, sold to third parties, or used for advertising without your explicit consent.

8. Meta (Instagram/Facebook) Integration

8.1 What We Access

When you connect your Instagram or Facebook account to Hausprice:

  • We request only the permissions necessary to post content on your behalf.
  • We access your account through Meta's official OAuth flow and Graph API.
  • We store an access token to publish posts when you initiate them.

8.2 What We Do

  • We generate social media content (posts, captions, images) using AI based on your property data and preferences.
  • We publish content to your connected accounts only when you explicitly choose to post.
  • We do not access your direct messages, follower lists, or any data beyond what is needed for content publishing.

8.3 What We Do NOT Do

  • We do NOT post content without your explicit action.
  • We do NOT access or store your Meta/Instagram/Facebook password.
  • We do NOT sell, license, or share your Meta data with any third party.
  • We do NOT use Meta data for advertising, profiling, or any purpose beyond providing the social posting feature.

8.4 Revoking Access

You may disconnect your Meta accounts at any time through:

  • Your Hausprice account settings
  • Your Meta/Instagram/Facebook account settings (removing Hausprice as a connected app)

Upon disconnection, we delete your Meta access token within 30 days.

8.5 Meta Platform Compliance

Our use of Meta APIs complies with Meta Platform Terms, Meta Developer Policies, and all applicable Meta data use policies. We undergo Meta App Review and adhere to all conditions imposed during that review.

9. Third-Party Services

The Service integrates with third-party services including Stripe, Supabase, Google Maps Platform, Walk Score, Meta, Anthropic (Claude AI), Google Gemini, Vercel, and Resend.

  • Your use of these third-party services through Hausprice is also subject to their respective terms of service and privacy policies.
  • We are not responsible for the practices of third-party service providers beyond the data we share with them as described in our Privacy Policy.
  • Google Maps content is provided subject to the Google Maps/Google Earth Additional Terms of Service.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Hausprice is NOT liable for:

  • The accuracy, completeness, or reliability of any AI-generated content, including property value estimates, condition assessments, and market analysis.
  • Financial losses, lost profits, lost deals, or other damages arising from the use of or reliance on AI-generated content.
  • Decisions made by you, your clients, or any third party based on information provided by the Service.
  • Content you publish to social media through the Service's Meta integration.
  • Interruptions, errors, or delays in the Service.
  • Loss or corruption of data, except where caused by our gross negligence.
  • Actions or omissions of third-party service providers.
  • Consequences arising from the AI chatbot providing incorrect or incomplete information to Portal Users.

Maximum Liability: In no event shall Hausprice's total aggregate liability to you for all claims arising from or related to your use of the Service exceed the total amount you have paid to Hausprice in the twelve (12) months immediately preceding the event giving rise to the claim. For free Portal Users, this amount is zero dollars ($0 CAD).

11. Indemnification

You agree to indemnify, defend, and hold harmless Hausprice, its founders, officers, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from:

  • Your use of the Service.
  • Your violation of these Terms.
  • Your violation of any law or the rights of any third party.
  • Any claim that you presented Hausprice reports as certified appraisals.
  • Content you upload to the Service or publish through the Service's social media features.
  • Your use of Portal User (lead) data in violation of PIPEDA, CASL, or any other applicable law.
  • Disputes between you and your clients arising from information in Hausprice reports.

12. Account Termination

12.1 By You

You may cancel your account at any time through your account settings or by contacting us at info@hausprice.ca. Upon cancellation:

  • Your subscription ends at the close of the current billing period.
  • You may export your data before your account is downgraded.
  • Your data is retained for 90 days for account recovery, then permanently deleted (except as required by law).

12.2 By Us

We may suspend or terminate your account immediately if:

  • You violate these Terms, including the Acceptable Use provisions in Section 6.
  • We are required to do so by law or regulatory order.
  • Your use of the Service poses a security risk or legal liability.
  • Your account has been inactive for more than 24 months.
  • We discontinue the Service (with at least 60 days' notice).

12.3 Effect of Termination

Upon termination:

  • Your right to use the Service ceases immediately (or at the end of the billing period, if terminated by you).
  • We retain your data in accordance with our Privacy Policy.
  • You may request a data export within 30 days of termination.
  • Meta access tokens are deleted within 30 days.
  • Provisions that by their nature should survive termination (including Sections 5, 7, 10, 11, 13, and 14) shall survive.

13. Governing Law and Dispute Resolution

13.1 Governing Law

These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.

13.2 Good Faith Negotiation

Before initiating any formal dispute resolution process, you agree to contact us at info@hausprice.ca and attempt to resolve the dispute informally for at least 30 days.

13.3 Jurisdiction

If the dispute cannot be resolved through good faith negotiation, you agree that any legal action or proceeding shall be brought exclusively in the courts located in the Province of Ontario, Canada.

13.4 Exceptions

Nothing in this section prevents either party from seeking injunctive or equitable relief related to intellectual property or confidentiality in any court of competent jurisdiction.

13.5 Class Action Waiver

To the extent permitted by law, you agree that any dispute resolution proceedings will be conducted on an individual basis and not as part of a class, consolidated, or representative action.

14. General Provisions

14.1 Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible. All remaining provisions continue in full force and effect.

14.2 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Hausprice regarding the Service. They supersede all prior agreements, representations, and understandings.

14.3 Waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

14.4 Assignment

You may not assign or transfer your rights under these Terms without our written consent. We may assign our rights and obligations without restriction, including in connection with a merger, acquisition, or sale of assets.

14.5 Force Majeure

Hausprice shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including natural disasters, pandemics, government actions, internet outages, or third-party service failures.

14.6 Language

These Terms are drafted in English. In the event of any conflict between an English version and a translated version, the English version shall prevail.

14.7 Notices

Notices to you will be sent to the email address associated with your account. Notices to us should be sent to info@hausprice.ca. Notices are effective upon receipt.
